Can't Pay a NY Traffic Fine? Get an Installment Plan—or Ask the Judge to Reduce What You Owe

New York Vehicle and Traffic Law allows installment plans for qualifying traffic fines and lets judges waive or reduce certain fines, fees and surcharges in the interests of justice.

What to do

Start here: Ask the sentencing court for a VTL §1802 installment plan and submit the financial disclosure the court requires; separately ask whether waiver or reduction is appropriate.

Eligibility: The court may require a Financial Disclosure Report. The ordinary minimum installment is $25 per month, although a judge may set an amount up to 2% of net monthly income under the rule.

A court can place qualifying traffic debt on monthly installments and can consider a waiver or reduction based on the statutory process.

Benefit: Time to pay without added installment-plan interest or charges, plus a possible judicial reduction or waiver.
